Do I need a lawyer to buy property in Portugal?

Portuguese law does not require a buyer to appoint a lawyer. However, legal representation is strongly recommended, particularly for foreign buyers unfamiliar with Portuguese property law, planning regulations and conveyancing procedures.

What is property due diligence?

Property due diligence is the legal investigation carried out before purchasing a property. It aims to identify ownership, planning, licensing, tax and contractual risks that could affect the transaction.

What documents should be checked before buying property in Portugal?

At a minimum: Land Registry Certificate; Property Tax Certificate; Use Licence; Municipal planning information; Condominium documentation (where applicable); Building Licence and Approved Plans (where applicable).

Do all Portuguese properties require a Building Licence?

No. Properties constructed before 7 August 1951 may, depending on the circumstances, be exempt from the requirement to hold a building licence. For properties constructed after that date, building licences and approved plans are generally important documents that should be reviewed during the due diligence process. In addition, it is essential to verify whether any later extensions, annexes, swimming pools or alterations were properly authorised.
